A note from the App Creators: Privacy in the 21st century is an increasingly complex issue. Below we try to transparently outline your privacy options, which go above and beyond what is currently legally required.

As background, app activity gets collected as app data in order to understand the most basic functions of what is happening when a user uses an app, such as did the user find the settings screen, or did the app crash, or where do they need the weather forecast from. In addition, data on which device or where a device is located is instrumental in figuring out which advertisers want to show their ads in an app. The app ecosystem relies on third-party tools to figure out much of this and thus results in some sharing of some app activity and device information with the third-party. You can opt-out of most of this below, and doing so will impair our ability to sell our ad space and understand what is happening in the app.

However, the best way to ensure no app ever collects or shares any information from your device is to never install an app. Even then, the device operating systems, manufacturers, internet connection and telecom companies all keep collecting activity data from the device. It’s not all bad though, there are many new privacy regulations (GDPR, CCPA, etc.) emerging that are forcing the whole ecosystem to change. In the meantime, we will follow the best practices and have provided you with the available opt-out options below. Lastly, we specifically don’t ask for your name, email address, personal address or ask you to create an account so any device data we ever collect is either anonymous or at worst pseudo-anonymous.

Weather Creative Inc. collects information about you when you use our Weather Kitty mobile applications, websites, and other online products and services (collectively, the "Services") and through other interactions and communications you have with us. Weather Creative Inc. is referred to herein collectively as "Weather Creative" or "we").

Scope of Application

This Privacy Statement ("Statement") applies to persons anywhere in the world who use our apps or Services ("Users").


COLLECTION OF INFORMATION

Information you provide to us

We collect information you provide directly to us, such as when you contact customer support, or otherwise communicate with us. This information may include: name, email, phone number, and other information you choose to provide. This information is not combined with any other information that is collected through the use of our services as outlined below.


Information we collect through your use of our services

When you use our Services, we collect information about you in the following general categories:

-Transaction Information: We collect transaction details related to your purchases of our Services, including the type of purchase, date and time of the purchase, amount charged, and other related transaction details.
-Device Information: We may collect information about your mobile device, including, for example, the hardware model, operating system and version, preferred language, advertising identifiers, and mobile network information. We do not collect your permanent device identifier or serial number.
-Log Information: When you interact with the Services, we collect server logs, which may include information like access dates and times, app features or pages viewed, and app crashes and other system activity.
-Location Information: When you enable and use location-based services with our Services, our partners and we may utilize certain geographic tracking technology, such as GPS or Bluetooth signals sent by a mobile device, to determine real-time geographic location of your computer or mobile device. This location information is collected pseudo-anonymously in a form that does not personally identify you in a traditional manner such as email, name, home address and is used by Weather Creative and its partners to provide and improve location-based products and services.


Important information about Consent and platform permissions


We disclose data collection, request consent, and provide opt-out information when a user first uses the Services. In addition, each mobile platform (iOS, Android, etc.) have defined certain types of device data that apps cannot access without the user's consent. These platforms have different permission systems for obtaining your consent. iOS will alert you the first time the app wants permission to access certain data or features of your phone, such as GPS, camera, or bluetooth and will let you consent (or not consent) to that request. Android devices will notify you of the permissions that the app seeks before you first use the app, often again when the app first asks to use the permission. Your use of the app and allowing the permissions constitutes your consent.


Use of information

We may use the information we collect about you to:

  • Provide, maintain, and improve our Services, including, for example, to develop new features, provide customer support to Users, and send product updates and administrative messages;
  • Perform internal operations, including, for example, to prevent fraud and abuse of our Services; to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends;
  • Personalize and improve the Services, including to provide or recommend features, content, and advertisements.
  • Analyze attribution, understand industry trends, and conduct research.
  • Share data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple's policies and only as necessary to process your requests.

We may transfer the information described in this Statement to, and process and store it in, the United States and other countries, some of which may have less protective data protection laws than the region in which you reside. Where this is the case, we will take appropriate measures to protect your personal information in accordance with this Statement.


Sharing of information

We may share the information we collect about you as described in this Statement or as described at the time of collection or sharing, including as follows:

  • With law enforcement officials, government authorities, or other third parties if we believe your actions are inconsistent with our User agreements, Terms of Service, or policies, or to protect the rights, property, or safety of Weather Creative or others;.
  • In connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company;
  • If we otherwise notify you and you consent to the sharing; and
  • In an aggregated and/or psuedo-anonymized form.

YOUR CHOICES

Access Rights

We will comply with individual's requests regarding access, correction, and/or deletion of the personal data it stores in accordance with applicable law.

Opting-Out of Information Sharing

You can throw a wrench in most pseudo-anonymous tracking by opting out of personalized advertising on Android and iOS through your device settings. Please note that these opt outs will disable personalized ads from all providers on all of your apps, and not just on our mobile applications.

Interest-Based Advertising

We may partner with various third parties to serve interest-based advertising ("IBA") in our app, and to track and report on the performance of those advertisements. These entities may use cookies, web beacons, SDKs, and other technologies to identify your device when you visit our site and use our Services, as well as when you visit other online sites and services.

Browser Choices: For more information about IBA, and to learn how you can exercise choice regarding the practice on your browser for companies that participate in the Digital Advertising Alliance ("DAA") WebChoices tool, you can visit http://www.aboutads.info/choices or TrustArc. Note that electing to opt out from IBA will not stop advertising from appearing in your browser or applications. It may make the ads you see less relevant to your interests, and result in less revenue for us for showing you the ad. In addition, note that if you use a different browser or device, erase cookies from your browser, or reset your platform ad identifier, you may need to renew your opt-out choice. In addition, companies may still collect data in browsers or apps for non-IBA purposes such as for analytics and reporting purposes, operations, improving our or their Services, and frequency capping.


Opting-Out of Location Collection

We request permission for our app's collection of precise location from your device per the permission system used by your mobile operating system. If you initially permit the collection of this information, you can later disable it by changing the location settings on your mobile device. Third-party Partners

Third-party Partners we may share data with are listed below along with our reason for sharing in parenthesis and a link to their privacy policy, which includes their opt-out options.


Promotional Communications

You may opt out of receiving promotional messages from us by following the instructions in those messages. If you opt out, we may still send you non-promotional communications, such as those about Services you have requested, or our ongoing business relations.

Your California privacy rights and CCPA

California law permits residents of California to request certain details about how their information is shared with third parties for direct marketing purposes. Weather Creative does not share your personally identifiable information with third parties for the third parties' direct marketing purposes unless you provide us with consent to do so.
Users from California have the right not to be discriminated against due to their data choices.

Children's privacy

Our Application is intended for general audiences over the age of 13 years old. We do not knowingly collect Personal Information from children under the age of 13 years old. If you are not over 13 years old, DO NOT DOWNLOAD OR USE THIS APPLICATION.


If we are notified that a child under 13 has provided personal information, we will delete that information as soon as reasonably possible. If you become aware that a child under 13 has provided such information, please send us a detailed email at support@weathercreative.com so we can delete this information.

Changes to the statement

We may occasionally update this Privacy Policy to reflect changes in our practices and services. When we post changes to this Privacy Policy, we will revise the "Effective Date" at the top of this Privacy Policy. If we make any material changes in the way we collect, use, and/or share your Personal Information, we will notify you by prominently posting notice of the changes in the Services. We encourage you to periodically review the Statement for the latest information on our privacy practices.

Selling of Information

You can opt out of the selling of any personal information you provide (if any) by clicking this link from within the app: Do Not Sell My Personal Information. It will not work if clicked from the website, since we’ll have no idea which device is requesting this. You can also message your request via this webform, but it will not happen instantly like in the other option and will require some back and forth to verify your user record.
